Welcome to GTE Engineering! The terms “we”, “us,” and “our” refer to GTE Engineering LLC. GTE Engineering operates this store and website, including all related information, content, features, tools, products, and services to provide you with a curated shopping experience (the “Services”). GTE Engineering is powered by Shopify, which enables us to provide the Services to you.
The terms and conditions below, together with any referenced policies (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence and have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.
To use the Services, including accessing or browsing our online stores or purchasing any products or services, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete, and that you have all rights necessary to provide it.
You are solely responsible for maintaining the security of your account credentials and for all account activity. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 - OUR PRODUCTS
We make every effort to accurately represent our products and services in our online stores. However, colors or product appearance may differ based on your device and settings. We do not warrant that any products or services will meet your expectations or match the depictions in our online stores.
All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product and may limit quantities offered to any person, geographic region, or jurisdiction on a case-by-case basis.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. GTE Engineering reserves the right to accept or decline any order at its discretion. Your order is not accepted until GTE Engineering confirms acceptance. We must receive and process your payment before acceptance. Please review your order carefully before submitting, as cancellation requests may not be accommodated after acceptance. If we do not accept, make a change to, or cancel an order, we will attempt to notify you using the contact details provided at checkout.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy: https://gteeng.com/policies/refund-policy. You represent and warrant that your purchases are for personal or household use and not for commercial resale or export.
Rebuilt parts, except where approved by GTE, are final sale, as we cannot revert a rebuild or remove installed parts or labor. Rebuilt parts have a 30-day craftsmanship warranty and Labor if installed at GTE Engineering.
Section A – Liability Exclusion
Under no circumstances shall we be responsible or liable for shipping damage, installation labor, installation errors, diminished value, consequential or incidental damages, diagnostic or removal costs, taxes, shop fees, penalties, loss of use, delays, transportation or storage expenses, improper handling, or any other direct or indirect expense, loss, claim, or liability arising from the part, its shipment, installation, misuse, or any related circumstance.
Section B – Insurance & Legal Fees
The customer’s insurance shall be solely and primarily responsible for any claims, fees, losses, or damages of any kind, without exception, and must be fully exhausted before any claim is made against us. We shall not be responsible for attorney fees, court costs, legal expenses, or any form of dispute-related costs under any circumstances.
SECTION 4 - PRICES AND BILLING
Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the one in effect at the time the order is placed and reflected in your order confirmation email. Unless expressly stated, posted prices do not include taxes, shipping, handling, customs, or import charges.
Prices in our online stores may differ from prices in physical stores or in stores operated by third parties. We may offer promotions governed by separate terms. If promotion terms conflict with these Terms, the promotion terms govern.
You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases. You agree to promptly update your account and other information, including your email address and credit card details, so transactions can be completed and we can contact you as needed.
You represent and warrant that (i) your credit card information is true, correct, and complete, (ii) you are duly authorized to use the card, (iii) charges will be honored by your credit card company, and (iv) you will pay charges incurred by you at posted prices, including shipping, handling, and taxes.
SECTION 5 - SHIPPING AND DELIVERY
We are not liable for shipping and delivery delays. Delivery times are estimates only and not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control. Once we transfer products to the carrier, title and risk of loss pass to you.
If you select shipping insurance, payouts are subject to shipping insurance Terms & Conditions (if applicable). We process insurance claims 15 to 30 business days after payout and deduct applicable fees or costs.
SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video, audio, and their design, selection, and arrangement, are owned by GTE Engineering, its affiliates, or licensors and are protected by U.S. and foreign intellectual property laws.
These Terms permit personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works, display, perform, republish, download, store, or transmit any material from the Services without our prior written consent. Nothing herein grants you any intellectual property rights of GTE Engineering, Shopify, or any third party. Unauthorized use may violate federal and state laws. All rights not expressly granted are reserved.
GTE Engineering’s names, logos, and related designs are trademarks of GTE Engineering or its affiliates or licensors. You must not use such trademarks without prior written permission. Shopify’s marks belong to Shopify. Other names and logos on the Services are trademarks of their respective owners.
SECTION 7 - OPTIONAL TOOLS
You may be provided access to customer tools offered by third parties as part of the Services, which we do not monitor or control. You acknowledge and agree that we provide access to such tools “as is” and “as available” without warranties of any kind or endorsement. We have no liability for your use of optional third-party tools.
Your use of these tools is entirely at your risk and discretion, and you should ensure familiarity with their terms.
We may also offer new features through the Services in the future. Such features are deemed part of the Services and subject to these Terms.

GTE Engineering is powered by Shopify, which enables us to provide the Services. Sales and purchases are made directly with GTE Engineering. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and GTE Engineering, including injury, damage, or loss resulting from purchased products or services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities related to your purchases and transactions with GTE Engineering.

All personal information collected through the Services is subject to our Privacy Policy [LINK], and certain information may be subject to Shopify’s Privacy Policy. By using the Services, you acknowledge that you have read these policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access and use to provide and improve the Services. Information you submit will be shared with Shopify and third parties that may be located in other countries to provide services to you. We may, but have no obligation to, monitor, edit, or remove Feedback we find unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable or in violation of intellectual property or these Terms.
You agree your Feedback will not violate any third-party rights, contain defamatory or illegal material, or include malware. WE DO NOT GUARANTEE THAT USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS MAY LIMIT DISCLAIMER OF IMPLIED WARRANTIES, SO THIS MAY NOT APPLY TO YOU.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL GTE ENGINEERING OR ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, REVENUE, SAVINGS, DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS, OR FOR ANY OTHER CLAIM RELATED TO USE OF THE SERVICES OR ANY PRODUCT, INCLUDING ANY CONTENT ERRORS OR OMISSIONS, OR LOSS OR DAMAGE INCURRED AS A RESULT OF CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE, EVEN IF ADVISED OF POSSIBILITY.

You agree to indemnify, defend, and hold harmless GTE Engineering, Shopify, and their affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys’ fees, arising out of (1) your breach of these Terms, (2) your violation of law or third-party rights, or (3) your use of the Services.
We will notify you of any indemnifiable claim; failure to notify will not relieve your obligations unless materially prejudiced. We may control the defense and settlement of claims at your expense, including counsel choice, but will not settle claims requiring your non-monetary obligations without your consent (not unreasonably withheld). You will cooperate in the defense, including providing relevant documents.

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall be enforced to the fullest extent permitted, and the unenforceable portion shall be deemed severed. This does not affect the validity of the remaining provisions.
SECTION 19 - WAIVER; ENTIRE AGREEMENT
Failure to exercise or enforce any right or provision of these Terms does not constitute a waiver.
These Terms and any policies or rules posted by us constitute the entire agreement between you and us and govern your use of the Service, superseding any prior agreements or communications. Ambiguities in interpretation shall not be construed against the drafting party.

You may not delegate, transfer, or assign this Agreement or any rights or obligations without our prior written consent. We may transfer or assign these Terms and our rights without consent or notice.
SECTION 21 - GOVERNING LAW
These Terms and any agreements whereby we provide Services are governed by and construed in accordance with the laws and courts of the jurisdiction where GTE Engineering LLC. is headquartered. You and GTE Engineering consent to venue and personal jurisdiction in such courts.

Headings are for convenience only and do not affect these Terms.

You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check periodically for changes. We will notify you of material changes as required by law, and such changes will be effective on the specified date. Continued use of the Services following changes constitutes acceptance.
